(I or We) HEARBY OFFER TO SURRENDER possession of the premises (I or We) occupy as tenants under that certain
rental Agreement between The Xxxxxxxx Apartment and (Me or Us), dated ________________________, on a month-to-month holdover
rental agreement. These premises are known as Apt. #________________________.
The proposed date is a firm date and is at least thirty (30) days from
the date this offer is served. (telephone calls or verbal notices are not
valid methods of service). (I or We) UNDERSTAND THAT THE SECURITY DEPOSITS WILL BE REFUNDED TO THOSE NAMES SHOWN ON THE CURRENT LEASE.
(I or We) EXPRESSLY UNDERSTAND that (I or We) will be required to quit and deliver up possession of said
premises on or before said date to you as the manager of The Xxxxxxxx Apartment who is authorized to receive possession of the same notice, whichever
is later (CCP Section 1946).
In the event (I or We) fail to vacate the subject premises upon the terms
herein set forth, it is agreed and understood that (I or We) shall be held
responsible for any damages which The Xxxxxxxx Apartment and/or a new resident applicant may incur for reason of the failure on
(My or Our) part to vacate premises in accordance with this notice (CCP
Section 1161).
(I or We) covenant and agree to hold The Xxxxxxxx Apartment harmless and indemnity it from any liability including attorny's fees
resulting from (My or Our) failure to vacate. The Xxxxxxxx Apartment is authorized to apply all or any portion of my security deposit to cover
any liability or breach by (me or Us) of this covenant, including any inconvenience
to the new applicant resident (CCP Section 1950.5).
(I or We) FURTHER EXPRESSLY UNDERSTAND that the effect of this offer will be to terminate residency upon the
above specified date, and that if (I or We) fail to quit and deliver possession
of the premises to you on or before said date, The Xxxxxxxx Apartment has the right to institute legal proceedings for the unlawful detainer
against (Me or Us) to recover possession of the premises and recover actual
damages, statutory damages up to $600.00 if malice is shown, and attorny's
fees and costs (CCP Section 1161).
If you are vacating before expiration of your Rental Agreement, according
to the conditions and terms of your Rental Agreement, you will be held
responsible for rent through the expiration date of your Rental Agreement,
OR until your apartment is re-occupied, whichever is the earliest date.
Until then, you are required to continue to pay your rent as is becomes
due. You are also responsible for pro-rated renovation costs dependent
upon how many months of the Rental Agreement term you have fulfilled (CCP
Section 1951.2).
